If you are interested in using the Website to post and find applicants for your positions, please review these Additional Terms of Use for Providers in addition to the general Terms of Use (which define terms used below) posted here. By posting a position (“Position”) on the Website, you also accept and agree to be bound and abide by these Additional Terms of Use for Providers. If you do not agree to these Additional Terms of Use for Providers, do not post a Position on the Website.

 

Provider Account

To post a Position on the Website, a Provider must create an account by entering a valid email address, contact name, and password. Once the account is created, you must add additional information to your Provider account, such as phone number, physical address, business name, business registration information, website, and any other information required by the Company. We also require information about your organization, such as photos and reviews, so that Applicants can learn as much as possible about your organization.

All information that you submit to the Website must be correct, current, and complete, and we reserve the right to remove any Position or cancel your account if you provide inaccurate or misleading information. All information that you provide on the Website is governed by our Privacy Policy available here, and you consent to all actions we take with respect to your information consistent with our Privacy Policy.

You are solely responsible for maintaining the confidentiality of your account information, as well as any and all activities that occur under your account. You must immediately notify us of any unauthorized use of your account and any other such security breach. We will not be liable for any loss that may occur as a result of someone else using your account or password, with or without your knowledge. You should use particular caution when accessing your account from a public or shared computer so that others are not able to view or record your password or other personal information.

You may terminate your account at any time by emailing info@abroadly.com. The Company may delay deletion of your account until any Positions for which Applicants have been accepted are complete. We reserve the right to disable any account at any time in our sole discretion for any or no reason.

 

Posting Positions

Once you set up a Provider account on the Website, you may post open Positions on the Website. The Company may request additional information from you about your organization, personnel, or Position, and such information must be provided before the Position will be posted and/or Applicants will be accepted for the Position. You are responsible for including any licenses, certifications, or any other information necessary to perform the Position.

The Company reserves the right to reject or remove any Position posting, for any or no reason, at its sole discretion.

 

Accepting Applications

If an Applicant applies for a Position posted by you on the Website, you will be notified by email and receive access to all of the Applicant’s application information. The Company does not review any Applicant information or verify, check, or otherwise screen Applicants. Therefore, it is your sole responsibility to review, verify, and confirm any information received by an Applicant, including any Applicant’s claim to possess any required licenses or certifications. The Company does not make any guarantees or promises regarding any Applicant or application.

If you would like to accept an Applicant, you must mark the Applicant’s application as “accepted” on the Website and the Applicant will be immediately notified. You are then responsible for working directly with the Applicant to work out all additional details, including dates, travel logistics, responsibilities, proof of credentials, vaccines needed, supplies or materials to bring, and any other information you may need. All payments for the Position are handled solely between the Provider and Applicant using the Provider’s payment processing system.

 

Safety

YOU UNDERSTAND THAT THE COMPANY DOES NOT SCREEN, VERIFY, OR PERFORM BACKGROUND CHECKS ON ANY USERS OF THE WEBSITE, INCLUDING APPLICANTS, AND THEREFORE YOUR USE OF THE WEBSITE TO POST POSITIONS AND ACCEPT VOLUNTEERS IS VOLUNTARY AND AT YOUR OWN RISK. YOU ARE RESPONSIBLE FOR DETERMINING THE IDENTITY AND SUITABILITY OF USERS WHO YOU MAKE CONTACT WITH VIA THE WEBSITE. WE WILL NOT BE RESPONSIBLE FOR ANY DAMAGE OR HARM RESULTING FROM YOUR INTERACTIONS WITH OTHER USERS. THE COMPANY SHALL NOT HAVE ANY LIABILITY ARISING FROM OR IN ANY WAY RELATED TO YOUR COMMUNICATIONS, RELATIONSHIPS, OR PARTICIPATION WITH APPLICANTS OR OTHER VOLUNTEERS FOUND ON OR CONNECTED TO VIA THE WEBSITE.

IF YOU FEEL UNSAFE OR HAVE AN EMERGENCY SITUATION WHILE WORKING WITH AN APPLICANT OR OTHERWISE CONNECTED TO A POSITION, CONTACT LOCAL EMERGENCY SERVICES IMMEDIATELY. DO NOT EVER CONTACT THE COMPANY IN AN EMERGENCY SITUATION. 

 

Issues with Applicants

If an issue arises between you and an Applicant before a Position begins, the Company invites you to contact us so we can try to assist in mediating the issue. If an Applicant refuses an accepted Position due to the Provider’s error or omission, you are responsible for paying the deposit amount paid by the Applicant to the Company to the Applicant within 10 business days.

If any issues arise between a Provider and an Applicant after a Position begins, the Provider must work with the Applicant or local authorities to resolve the issue. The Company does not have the capacity to assist you during any Position, so before beginning any Position you should ensure that you have the resources and information needed if an issue arises. The Company provides a platform for you to find and arrange volunteers, but is not liable for any issues, damages, or harm arising or resulting from any volunteer that you choose to accept. 

 

Cancellations and Refunds

If you cancel the Position after accepting an Applicant’s application, you are responsible for notifying the Applicant and the Company immediately and refunding all money paid by the Applicant for the Position, including any non-refundable payments made by Applicant to third parties and the deposit paid by the Applicant to the Company, to the Applicant within 10 business days.

 

No Guarantees

YOU ACKNOWLEDGE THAT THE COMPANY DOES NOT SANCTION, SPONSOR, APPROVE, AND/OR PROVIDE ANY WARRANTIES OR GUARANTEES RELATED TO THE ACCURACY, QUALITY, SUITABILITY, SAFETY, OR ABILITY OF APPLICANTS ON THE WEBSITE. BY USING THE WEBSITE, YOU AGREE THAT THE COMPANY HAS NO RESPONSIBILITY OR LIABILITY TO YOU RELATED TO ANY APPLICANT ON THE WEBSITE, OTHER THAN AS EXPRESSLY SET FORTH IN THESE TERMS.


IT IS SOLELY YOUR RESPONSIBILITY TO DETERMINE IF AN APPLICANT WILL MEET YOUR NEEDS AND EXPECTATIONS. FURTHERMORE, YOU ACKNOWLEDGE THAT YOU MAY BE EXPOSED TO SITUATIONS INVOLVING THIRD PARTIES THAT ARE POTENTIALLY DANGEROUS OR OTHERWISE OBJECTIONABLE, AND THAT YOUR INVOLVEMENT WITH VOLUNTEERS THAT ARE IN ANY WAY CONNECTED TO THE WEBSITE ARE AT YOUR OWN RISK AND JUDGMENT. THE COMPANY SHALL NOT HAVE ANY LIABILITY ARISING FROM OR IN ANY WAY RELATED TO YOUR TRANSACTIONS, RELATIONSHIPS, OR PARTICIPATION WITH APPLICANTS OR VOLUNTEERS, WHETHER OR NOT THEY ARE CONNECTED TO THE WEBSITE.

 

Feedback

In the event that you provide us any ideas, thoughts, criticisms, suggested improvements, or other feedback related to Website (collectively “Feedback”), you agree we may use the Feedback to: (a) improve our Website and (b) promote the Website, and that you will not be due any compensation for your Feedback that is used in these ways. To the extent that we have your name, likeness, or voice, this will be part of the Feedback and you agree that we may use your name, likeness and voice in the same manner that we can use other Feedback. You grant to us a worldwide, royalty-free, fully paid, perpetual, irrevocable license to use, reproduce, modify, translate, distribute, perform, display, import, sell, offer for sale, make, have made and otherwise exploit the Feedback in any form, media, or technology, whether now known or hereafter developed, and to allow others to do the same. This is true whether you provide the Feedback on the Website or through any other method of communication with us, unless we have entered into a separate agreement with you that provides otherwise.
